While the laws on recording video are pretty lax, the same is not true for audio. Hidden camera laws are still pretty hazy. However, a majority of states require at least one party in a conversation to consent to audio recording before they can record a conversation either on the phone or in person.
There are ten states, including California, Florida and Illinois, that require both parties in a conversation to consent before they can record a conversation, so make sure you double-check before you record audio.
If you can naturally overhear a conversation in a public place and pick it up on a recording, that is generally deemed fine, but it is illegal to covertly record audio whether the recording device is hidden in a phone or somewhere in a home, office, shop or elsewhere.
